TERMS & CONDITIONS
These terms & conditions relate to all orders placed with Bayspoke Printing & Embroidery situated at 1 The Meadows, Broomfield, Herne Bay Kent CT6 7XB (we, us, the company etc) by the customer (you). These do not affect your Statuary Rights.
1. ACCEPTANCE

1.1 By placing an order with us you agree to these Terms and Conditions which form the only agreement between us.
2. VARIATION
-
2.1 Variation of these terms can only be made by us in writing.
3. PRICE AND PAYMENT
-
3.1. The prices that apply to any order are those offered on our web site at the time of ordering or those provided to you via quotation. Quotations will last up to 14 days.

3.2. Where you request a quotation for a product not listed on our site the quotation price shall apply for up to 14 days.

3.3. All prices are subject to carriage and other charges as set out on the website.

3.4. Full payment is due at the time of order unless other terms are agreed in writing.

3.5. Account customers payments shall be due in accordance with the agreed terms.

3.6. In the event of payment not being made when due, or of payment not being honoured by your bank, we will take action to recover the debt and will charge interest a £10 fee per week until full payment (including all interest and our costs) is received, whether before or after judgement.

4. DELIVERY

4.1 We aim to ship goods within 5 working days (non customised items) and 10 working days (customised items). Items ordered which are not in stock with our supplier may take extra time. Please contact us prior to purchase if you have an order deadline and we will advise of the order time.

4.3 Title of the goods will pass to you on full payment of the goods.

4.4 Items are posted via Royal Mail may take longer than the 3-5 working days they advise. When placing an order, you understand that this is out of our control and will allow up to 30 days for your order to arrive.

4.5 Claims for damaged or short delivered goods will not be accepted unless notified within 48 hours of the delivery date.

5. AMENDMENT OR CANCELLATION OF ORDERS

5.1 Orders of non customised items can be amended or within 24 hours of order placed, if not already dispatched.

5.2 Orders of customised items can only be amended or cancelled within 4 hours of purchase, or until the point when logo approval is given (if visual is provided after purchase). Artwork cannot be amended once it has been approved.

5.3 Any items we need to order from our supplier, cannot be cancelled or amended after the order is placed.

5.4 Non-customised items that have been ordered in error can be returned after you have informed us by either phone or email. Such return requests must be made within 48 hours of your receipt of goods and the goods must be received by us within 5 working days of you notifying us. You must pay for the return postage of these items. No refund will be given for any postage costs and any returned goods must have their original tags and be in their original packaging. Any returned goods that are un-saleable will not be credited.

5.5 Customised, made to measure and special order items cannot be returned unless they are found to be faulty.

5.6 It may be possible to merge multiple orders when placing an order, please contact us to discuss.

6. FAULTY GOODS

6.1 In the event that goods are found to be faulty this should be reported to us within 48 hours of receipt. We will then make the necessary arrangements to address this problem.

7. LIABILITY

7.1 We will replace faulty goods at our expense but will not be liable for any labour cost, administrative cost, loss of profit or any other compensation arising from any problem relating to the goods.

7.2 Delivery times are given as a guide and we will not be liable for any loss or cost resulting from a late delivery.

7.3 We cannot be held liable for any failure or delay due to acts of God, strikes, fire, war, accidents, strikes, lock outs, foot and mouth restrictions or other contingencies outside our control.

7.4 Our web site contains a great number of measurements and details and these are offered as a guide only. If any measurement is found to be wrong and causes a problem for you we will replace or refund the value of the product but will not be liable for cost or compensation.

8. DISPUTES

8.1 Disputes arising from our supply shall be dealt with under English Law.

8.2 These conditions do not affect your statutory rights.

9. WARRANTIES & SUITABILITY

9.1 Where a guarantee is given that exceeds your entitlement under English Law such guarantees are offered by the product manufacturer and not Bayspoke Printing & Embroidery. We will assist you in pursuing any claim you have under a manufacturer's guarantee.

9.2 This site is published with the intention of assisting you, our customers and all information is provided in good faith. We cannot guarantee the accuracy of the information or suitability for the purpose of any product. We, any of our staff or directors will not accept liability for any loss or damage arising from the use of this site or the information within it.

10. COPYRIGHT & TRADEMARKS

10.1 The information on this site and any artwork created is copyright of Bayspoke Printing & Embroidery. You may copy the information for the sole purpose of ordering from us. Any other use of this site and its contents is prohibited without our written agreement.

10.2 Trademarks and names included in this site are owned by us or our suppliers, partners or customers and should not be used in a way that infringes on their holders rights.

11. ONLINE SECURITY & SAFETY

11.1 We will do our utmost to ensure that we deal with you in a safe way.

11.2 Our Computer system is protected by a firewall that is designed to prevent hackers from gaining access to our computer held records. We cannot guarantee that hackers will not break our security and will not accept any liability of any loss if such an event occurs.

11.3 We use anti virus software to scan all emails before transmission but we cannot be held responsible for any damage or loss arising from such an event occurring.

12. KEY PERSONNEL

12.1 Only key personnel are authorised to enter into a binding legal relationship on behalf of Bayspoke Printing & Embroidery - these people are Lucy Howes & Michael Howes.

13. ARTWORK APPROVAL
-
13.1 For customised items, the first time a new logo is used, we will require you to check all details including quality, colour, spelling, and you must advise us of the size of the artwork you require, alongside any other specifications. We accept no responsibility for any artwork errors found after this has been approved. If an error is found after this approval process, any rework will be treated as a new order and billed accordingly. Once approved you will be unable to alter, change or return your order unless the garments are faulty.

13.2 By approving a logo, confirming a visual or placing an order from a purchase page set up for you, you are agreeing that you are happy for us to proceed with your order.

14. PROMOTIONAL CODE TERMS AND CONDITIONS

14.1 We reserve the right to decline or cancel orders where, in its opinion, a promotion code is invalid.

14.2 Promotion codes are only valid on specific products or under specific terms, while stocks last and may be withdrawn at any time.

14.3 In the event of product returns due to fault and a refund must be given, refunds will be given for the value of the original purchase, i.e.: With applied discount. Not at the RRP of the item.

14.4 If an invalid promotional code has been used on personalised/custom items, we will contact you to advise and request additional payment. We reserve the right to do this. If unpaid for 7 days, will cancel the order with a refund subject to a £5 fee. We will not dispatch the order while there is an outstanding payment due.
